Dangote Lamu Refinery: Kenyan Court Orders Status Quo On Disputed Land Ahead Of Groundbreaking

A Kenyan court has ordered parties in a land dispute involving the proposed Dangote Lamu refinery to maintain the status quo on a disputed parcel in Lamu County, days before the planned groundbreaking ceremony for the 700,000-barrel-per-day project.

Justice Jane Onyango of the Malindi Environment and Land Court issued the order concerning LR No. 13061 in the Hindi/Manda Magogoni area of Lamu County after 133 residents of Chandavai challenged the development and raised concerns over alleged displacement, destruction of property and compensation. The court scheduled the substantive application for an inter partes hearing on October 14, 2026.

Court Orders Status Quo On Disputed Refinery Land

The Malindi Environment and Land Court directed the parties to maintain the prevailing status quo on LR No. 13061 until October 14.

The court declined to certify the application as urgent and directed the respondents to file their responses within 14 days before the matter is heard between the parties.

The ruling followed an application by residents of Chandavai who are challenging the use of the land for the proposed refinery project.

The court’s order does not amount to a blanket suspension of the Dangote refinery project.

The Star reported that the applicants had sought orders stopping the planned groundbreaking and development of the refinery, but the court did not grant that request.

Dangote Says Groundbreaking Will Proceed

The Dangote Group said the court ruling does not stop the planned groundbreaking ceremony for the refinery.

In a statement reported by Reuters, the company said the court had not halted the groundbreaking ceremony, although activities at the site could be affected by the order requiring the parties to maintain the status quo pending the October 14 hearing.

The planned groundbreaking is scheduled for September 30, 2026, with Kenyan President William Ruto expected to participate.

The distinction is important because the court has not ruled on the substantive claims brought by the residents. The October 14 hearing will provide an opportunity for the parties to present their respective positions.

Residents Challenge Land Acquisition And Compensation

The 133 Chandavai residents have raised concerns over what they describe as the takeover of land that their families have occupied and cultivated for generations.

According to reports on the court proceedings, the residents allege that homes, crops, trees and other property were destroyed in connection with preparations for the wider development.

They are also challenging aspects of the land acquisition and compensation process and have raised concerns about the absence of adequate resettlement arrangements.

The residents’ claims are allegations before the court and remain subject to determination through the legal process.

Environmental And Public Participation Concerns

The petitioners have also raised environmental and public participation issues concerning the proposed refinery.

Among their arguments is that the necessary environmental assessment and public participation requirements should be satisfied before the project proceeds.

The court has not yet made a final determination on those claims.

The October 14 hearing will therefore be an important stage in the dispute as the court considers the parties’ submissions.

Dangote Lamu Refinery To Have 700,000-Bpd Capacity

The proposed Dangote East Africa Refinery is planned as a 700,000-barrel-per-day facility in Lamu County.

The project is being developed as a major industrial investment with the backing of Dangote Group and the Africa Finance Corporation.

Kenyan reports have put the project value at about KSh2 trillion, while other reports have valued the investment at roughly $15 billion to $17 billion.

The refinery is expected to expand petroleum refining capacity in East Africa and support wider industrial and logistics activities around the Lamu development corridor.

Ruto Fast-Tracks Administrative Processes

Kenyan President William Ruto has previously said his government was working to accelerate administrative processes required for the Dangote refinery.

Ruto made the comments during a visit to the existing Dangote Petroleum Refinery in Lekki, Lagos, where he discussed the proposed Kenyan project with Aliko Dangote.

The Kenyan President described the project as an important regional investment with the potential to create employment and develop technical skills.

The proposed refinery is also expected to form part of the broader industrial development around Lamu.

Court Case Creates Fresh Legal Challenge

The land dispute has introduced a fresh legal issue just days before the scheduled groundbreaking.

However, the current court order should not be described as a complete halt to the refinery project. The court has ordered the status quo to be maintained on the disputed parcel while the application proceeds to an inter partes hearing on October 14.

The outcome of that hearing could determine what further directions the court gives concerning the disputed land and the residents’ claims.

For now, the Dangote Group says the groundbreaking ceremony will proceed, although activities at the affected site could be subject to the court’s interim order.
