Babadidi had approached the court challenging the validity of the APC senatorial primary and alleging that the exercise was not conducted in accordance with the party’s guidelines.
The case was heard by Justice Amina Aliyu Mohammed, who had earlier fixed the matter for the adoption of final written addresses before judgment. During the proceedings, Babadidi’s legal team presented evidence challenging the conduct of the primary, while the APC maintained that the exercise was duly conducted.
After the parties adopted their final written addresses, the court dismissed the suit, effectively allowing Damara’s emergence as the APC candidate for the Gombe South Senatorial District to stand at the Federal High Court level.

Counsel to the APC described the judgment as a vindication of the party’s position and its conduct of the primary election.
However, counsel to Babadidi said the legal team would study the judgment before determining the next course of action, including the possibility of an appeal.
The ruling has therefore resolved the challenge at the Federal High Court, although any appeal by the plaintiff could lead to further proceedings at the appellate courts.
Outside the courtroom, APC supporters expressed satisfaction with the judgment and pledged continued support for the party.
