An Ikeja High Court on Tuesday dismissed a defamation suit against Instagram celebrity Martins Otse, known as Verydarkblackman (VDM).
The suit was filed by human rights lawyer Femi Falana (SAN) and his son, Folarin, also known as Falz, following an audio recording made by cross-dresser Bobrisky, which accused them of perversion of justice.
The claimants sought significant damages for a video posted by VDM on social media.
When the case was called, neither Falana, his son, nor VDM were present in court.
VDM’s counsel, Mr. Niyi Alagbe, informed the court of a prior application for a stay of proceedings, which was submitted to Justice Fimisola Azeez.

However, Falana’s lawyer, Mr. Omotayo Olatunbosun, argued that the application was an attempt to delay the proceedings and asserted that the case was ready for hearing.
Justice Matthias Dawodu noted that the application was not included in the case file and questioned the need to proceed, given that the substantive suit was already before another judge.
Ultimately, he ruled to strike out the case, emphasising that pursuing it further will serve no purpose as the main suit was being handled elsewhere.
