Canada has clarified its citizenship-by-descent rules, explaining that people born outside the country may qualify as Canadian citizens if they can prove an uninterrupted line of descent from a Canadian parent or ancestor who was a Canadian citizen at the time the next generation was born.

According to guidance shared by Canadian immigration authorities through Canadavisa’s X account on Friday, citizenship is determined through a direct family line.

This means only parents, grandparents, or other direct ancestors can pass on Canadian citizenship, while relatives such as aunts, uncles, or cousins cannot.

The clarification comes after legal challenges prompted changes to previous restrictions that had prevented some descendants of Canadians born abroad from being recognized as citizens.

Authorities explained that eligibility depends on whether a parent held Canadian citizenship when their child was born.

“The Citizenship Act recognizes a person born abroad to a parent who was a citizen at the time of the birth,” the statement said.

Under the updated rules, some individuals who were previously considered ineligible may now be recognized as Canadian citizens from birth rather than acquiring citizenship only after submitting an application.

However, immigration officials stressed that citizenship cannot be passed retroactively. If a parent became a Canadian citizen after a child’s birth, that citizenship generally cannot be transferred to the child through descent.

Officials also clarified that marriage to a Canadian citizen does not automatically confer citizenship, while adoption by a Canadian citizen follows a separate legal process.

Prospective applicants are encouraged to trace their family history by identifying the oldest ancestor born in Canada and verifying that Canadian citizenship was maintained through each successive generation.

For those who meet the requirements, obtaining a citizenship certificate simply confirms a status they may have held since birth, rather than granting them new citizenship.
