Hollywood actress Halle Berry has been accused of allegedly choking her 12-year-old son, Maceo, in a fresh and explosive custody battle with her former husband, Olivier Martinez.
Martinez, a French actor and Berry’s former spouse, reportedly made the allegations in a court filing in which he asked for a temporary restraining order against Berry and sought sole custody of their son.
According to the filing, Martinez alleged that Berry physically assaulted Maceo during an incident on September 26.
He claimed the actress “jumped on him, put her hands around his neck, and choked him,” while also alleging that the incident was not isolated.
Martinez reportedly told the court that there had been previous instances of alleged physical, verbal and emotional abuse involving their son.
The allegations have triggered a fresh escalation in the long-running custody dispute between the former couple, with Martinez arguing that Maceo could have suffered emotional trauma from the alleged incidents.
He reportedly asked that Berry be prevented from having contact with their son until she takes responsibility for the alleged conduct.
Martinez also requested that Berry not be under the influence of alcohol or other substances during any future visitation with Maceo.
The former couple’s dispute reportedly goes beyond the latest allegations. Martinez claimed Berry previously made a derogatory remark about him to their son during an argument over child support and later apologised to Maceo in a text message.
However, Berry’s legal team has strongly rejected Martinez’s allegations.
Her attorney, Marina Beck, reportedly described the filing as “entirely meritless and deliberately misleading,” arguing that Martinez’s account does not accurately represent what has happened between the family.
Beck also accused Martinez of repeatedly violating existing court orders and interfering with therapeutic and educational interventions involving Maceo.
Berry’s attorney further claimed that Martinez had previously been sanctioned by the court, portraying his latest filing as part of a broader pattern of conflict rather than evidence of wrongdoing by the actress.
The allegations against Berry remain disputed, and no finding of wrongdoing has been established merely by the filing. The court will ultimately determine what action, if any, should be taken regarding custody and contact arrangements.

Berry and Martinez began dating after meeting during the production of the 2012 film Dark Tide. They married in 2013 and welcomed Maceo later that year.
Berry filed for divorce in 2015, and their separation subsequently became part of a prolonged custody and co-parenting dispute.
The latest court battle puts the Oscar-winning actress under renewed scrutiny, with the allegation involving her young son likely to attract significant attention in Hollywood and beyond.
For now, the central claims remain allegations made by Martinez and have been firmly denied by Berry’s legal representative.
