The 37-year-old singer was sentenced on Monday, October 26, 2026, at Southwark Crown Court after pleading guilty to affray in July.
Brown’s co-defendant, Omololu Akinlolu, 40, a rapper and vocal coach, was also handed a four-month prison sentence, suspended for 12 months, for his role in the incident.
Both men will avoid immediate imprisonment provided they comply with the terms of their suspended sentences.
What The Judge Said
Delivering his sentencing remarks, Judge Tony Baumgartner described Brown’s repeated use of a glass bottle to strike Diaw as “plainly dangerous”, warning that the attack could have resulted in significantly more serious injuries.
The judge said the incident occurred in the early hours of February 19, 2023, in the VIP section of Tape nightclub in London’s Mayfair district.
According to the court, Brown approached Diaw and struck him twice on the head with a tequila bottle before hitting him on the shoulder and attempting another strike.
The judge described the incident as brief but intense, noting that the violence, although not planned, carried significant risks.
Closed-circuit television footage presented in court showed the attack lasted less than 20 seconds, with Brown hitting Diaw four times with the bottle, including twice on the head.
Akinlolu was also involved in the assault, punching and kicking Diaw while he was on the ground, according to the court’s findings.
Judge Baumgartner said Akinlolu did not initiate the violence but became an active participant and played a significant role in the attack.
Diaw subsequently required hospital treatment for head trauma, tenderness around his cervical spine and abdomen, and reduced movement in his left knee.
The judge considered Brown’s leading role in the incident, his previous convictions involving violence in 2009 and 2013, and his compliance with bail conditions before determining his sentence.
However, he noted that Brown’s previous convictions were old and also considered his charitable activities, stable employment and responsibilities as a father of four.
The judge stressed that Brown’s fame, commercial success and professional standing did not entitle him to special treatment.
Both defendants were ordered to pay £1,500 each towards the prosecution’s costs.
Defence, Prosecution Arguments
Before sentencing, Brown’s defence lawyer, Sallie Bennett-Jenkins KC, described the incident as an “ugly and unattractive” episode that lasted between 17 and 20 seconds.
She told the court that Brown offered a profound apology to everyone present at the nightclub during the attack.
The defence also described the singer as a dedicated and loving father who had lived a law-abiding life since his last conviction in 2013.
Prosecutors, however, characterised the attack as vicious and unprovoked, stating that Diaw was assaulted while attempting to escape and was kicked while defenceless on the floor.

Charges Dropped After Guilty Plea
Brown had initially faced more serious charges, including assault, attempted grievous bodily harm and possession of an offensive weapon. Those charges were subsequently dropped after he pleaded guilty to affray.
Akinlolu also pleaded guilty to affray, while the assault and attempted grievous bodily harm charges against him were dropped.
Affray is an offence under British law involving the use or threat of unlawful violence in circumstances that would cause a person of reasonable firmness to fear for their safety.
The offence carries a maximum penalty of three years’ imprisonment.
Brown, one of the biggest names in American R&B, has won two Grammy Awards and recorded several hit songs, including With You, Turn Up the Music, Freaky Friday and Don’t Wake Me Up.
Despite his suspended sentence, the court’s ruling marks a significant development in the legal case stemming from the 2023 nightclub attack.
