PenCom sues 66 employers over failure to remit pension contributions

The National Pension Commission (PenCom) has taken 66 employers to court for their failure to contribute and remit their workers’ pension contributions to their Pension Fund Administrators (PFAs) last year.

Data obtained from PenCom revealed that 19 of the defaulting employers were recommended for legal action in the second quarter of 2021, while 29 employers were recommended in the third quarter and 18 in the fourth quarter of the year.

PenCom noted that following the issuance of demand notices to defaulting employers, whose pension liabilities had been established by the Recovery Agents (RAs), N608.5 million, representing the principal contribution of N162.3 million was recovered from 25 defaulting employers during the first quarter.
Continuing, it stated that following the issuance of demand notices to defaulting employers, whose pension liabilities were established by the RAs, N398 million, comprising Principal Contribution of N243.3 million and penalty of N154.6 million were recovered from 31 defaulting employers in the second quarter of the year.

It added that meanwhile, 19 defaulting employers were recommended for legal action.
The pension liabilities were established by the RAs, as N559.3 million made up of a principal contribution of N394.7 million and penalty of N164.5 million was recovered from 28 defaulting employers in the third quarter and 29 defaulting employers were recommended for legal action.

It maintained that 18 defaulting employers were recommended for litigation in the fourth quarter, adding that following the issuance of demand notices to defaulting employers whose pension liabilities were established by the RAs, N984.2 million, representing principal contribution N406.4 million and penalty of N577.8 million was recovered from 36 defaulting employers during the quarter.
