Judge Arun Subramanian, who is overseeing Diddy’s sex trafficking and racketeering trial, has announced that he will consider the mistrial motion on Tuesday.
On the 19th day of the trial, Judge Subramanian stated that he would postpone his decision on the defense’s request for a mistrial until Tuesday.
Diddy’s legal team submitted documents on Saturday, alleging that the prosecution provided false testimony.
During the trial, Cassie Ventura testified that she saw Diddy holding Bryana Bongolan over the edge of a balcony.
However, text messages suggest that Cassie informed Kristina Khorram, a Diddy employee, that she did not actually witness the incident but learned about it later, texting, “I just found out some crazy sh**.”
Prosecutors also presented photographs of Bongolan’s injuries, which they claim were inflicted by Diddy during the balcony incident.

The meta data of the photos indicates they were taken on September 26, 2016, a date when Diddy’s team asserts he was on the East Coast, far from the alleged incident in Los Angeles.
Before the jury was convened on Monday morning, Judge Subramanian mentioned that the prosecution would have the opportunity to respond to the mistrial motion today, prior to his consideration of it tomorrow.
“Jane,” a former girlfriend of Diddy testifying under a pseudonym, is expected to return to the stand today for her third day of testimony.
Last week, she discussed alleged drug use during her relationship with Diddy and the medical issues resulting from her “freak-off” episodes with him and others.
Saturday’s motion marks the second request for a mistrial from Diddy’s team; his lawyers previously sought a mistrial last month concerning fingerprint evidence related to the Kid Cudi investigations.
