The Peoples Democratic Party (PDP) has dragged Sen. Ned Nwoko before the Federal High Court, Abuja, seeking an order of the court to declare the Delta North Senatorial District seat vacant, following Sen. Nwoko’s defection to the All Progressives Congress (APC).
The PDP through its counsel, Dr. Ayo Asala (SAN) is praying the court to order the Independent National Electoral Commission (INEC) to conduct a bye-election to fill the vacant Senate seat.
In the originating summons dated February 27, 2025, the PDP is the plaintiff, while Sen. Nwoko, the Senate President, Godswill Akpabio, and the INEC are the first, second, and third defendants, respectively.
The plaintiff is also praying the court to direct Sen. Nwoko to return all salaries, allowances and other emoluments received by him as a senator representing the Delta North Senatorial District from the date he defected from the PDP to the APC.
In the originating summons, PDP is asking the court to determine whether, in regards to Section 68 (1)(g) of the 1999 constitution, Sen. Nwoko ought not to have vacated his seat as a senator representing Delta North Senatorial District, and whether the Senate president and INEC ought not to have declared his seat vacant.
