A High Court of the Federal Capital Territory (FCT) has dismissed a lawsuit filed by one Marvis Ossai, which sought to unseat Senator Ned Munir Nwoko following his defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).
In a ruling delivered on Wednesday, March 19, 2025, Justice A.H. Musa declared the case incompetent and without merit, stating that the court lacked jurisdiction to entertain the claim. The lawsuit aimed to nullify Senator Nwoko’s Certificate of Return and declare the Delta North Senatorial seat vacant due to his switch in political allegiance.
However, the court ruled that the claimant, Marvis Ossai, lacked the legal standing (locus standi) to file the case, rendering the suit legally void. The decision marked a decisive victory for Senator Nwoko, whose legal team successfully argued that the court had no authority over such political matters, particularly in the absence of a constitutional breach.

Senator Ned Munir Nwoko, representing Delta North Senatorial District, officially resigned from the PDP on January 30, 2025, citing deep-seated divisions and internal conflicts within the party.
In a resignation letter addressed to the PDP Chairman of Ward 8, Anioma North LGA, Delta State, Nwoko expressed disappointment over the growing factionalism within the party, which he said had hindered unity and progress. He referenced an incident on January 29, where top PDP officials engaged in physical altercations, describing the situation as “irreconcilable.”
