The National Drug Law Enforcement Agency (NDLEA) has confirmed that the substantive drug trafficking case against suspended Deputy Commissioner of Police Abba Kyari remains active and will continue on Monday, March 16, 2026.

The case is scheduled to resume before Justice Emeka Nwite at the Federal High Court in Abuja.

The clarification follows the recent discharge of Kyari by Justice James Omotosho on a 23-count charge relating to alleged non-declaration of assets.

According to the NDLEA, the judgment delivered by Justice Omotosho concerns a separate matter involving money laundering and asset declaration and does not affect the ongoing drug-related prosecution.

NDLEA’s Director of Media and Advocacy, Femi Babafemi, explained that the agency’s legal team is currently awaiting the Certified True Copy (CTC) of the judgment to carefully review the ruling before determining its next legal steps.

Babafemi said the prosecution team may decide whether to file an appeal after examining the full details of the court’s decision.

He stressed that the drug case, which is regarded as the main and substantive charge against the suspended police officer, remains firmly on course and will proceed as scheduled before Justice Nwite.

“First, I need to clarify that the ruling by Justice Omotosho is completely different from the main and substantive drug case, which continues before Justice Emeka Nwite on Monday. That one is very much on course,” Babafemi stated.

Kyari, a former head of the Police Intelligence Response Team, has been facing multiple legal battles since allegations linking him to an international drug trafficking network surfaced. The NDLEA has maintained that its prosecution on the narcotics charges is separate from other legal proceedings involving the embattled officer.

The continuation of the case next week is expected to draw significant public attention as the court resumes hearing on one of the most closely watched drug-related prosecutions involving a senior Nigerian police officer.
