Delta Assembly Tenancy Bill 2026 Targets Rising Rent, Agency Fees

The Delta State House of Assembly has taken steps to regulate the state’s tenancy sector as the Delta State Tenancy and Recovery of Premises Bill 2026 scaled second reading during Tuesday’s plenary.

The Bill, which was considered amid concerns over rising house rents, agency charges and other difficulties faced by tenants, particularly in Asaba, seeks to establish a clearer legal framework for landlord-tenant relationships and regulate property agents involved in tenancy transactions.

The plenary was presided over by the Deputy Speaker, Rt. Hon. Arthur Akpowowo.

Leading the debate, the Leader of the House, Hon. Emeka Nwaobi, urged lawmakers to support the Bill, saying it was designed to provide a clear legal framework for relationships between landlords and tenants and regulate the activities of agents involved in tenancy transactions.

Nwaobi noted that provisions of the proposed legislation had previously been considered by the lawmakers.

Following the debate, the House unanimously adopted the motion through a voice vote, allowing the Bill to scale its second reading.

Further consideration of the Bill was deferred to the next sitting of the House.

Delta Tenancy Bill Comes Amid Rising Housing Costs

The proposed legislation comes amid growing concerns over housing costs in Asaba and other urban centres across Delta State, particularly among low- and middle-income earners.

Prospective tenants in Asaba often face steep annual rents as well as agency and legal charges before securing accommodation.

In some cases, the combined cost of securing a property can significantly exceed the advertised annual rent, increasing the financial burden on workers, young professionals, families and other residents.

There are also concerns over the activities of some unregulated agents and intermediaries who allegedly impose arbitrary charges, advertise properties without clear authority from landlords or demand payments from multiple prospective tenants for the same property.

For many residents, the challenge extends beyond the cost of rent to the cumulative expenses involved in securing accommodation.

Bill Seeks Clearer Rules for Landlords, Tenants and Agents

The passage of the Delta State Tenancy Bill 2026 for second reading could provide an opportunity for the state to establish clearer rules and greater accountability in the rental market.

Beyond tenant protection, the proposed legislation could provide landlords with clearer procedures for recovering premises from defaulting tenants, helping to balance the interests of both parties and reduce tenancy-related disputes.

The Bill is also expected to address concerns surrounding the recovery of premises by establishing clearer rules on notices, tenancy agreements and the responsibilities of landlords, tenants and property agents.

A properly regulated tenancy environment could help curb sharp practices, reduce avoidable disputes and make the process of renting property more transparent.

As the Bill proceeds to further consideration, attention is expected to focus on how its provisions will address rent increases, agency charges, tenancy agreements, recovery of premises and the conduct of property agents.

The effectiveness of the proposed law will ultimately depend on the details of its provisions and how effectively they are enforced.

The development signals the Delta State House of Assembly’s intention to respond legislatively to challenges in the housing sector and establish a more predictable relationship between landlords, tenants and property agents across the state.
