An Enugu High Court has restrained the sacked National Secretary of the Peoples Democratic Party (PDP), Senator Samuel Anyanwu from parading himself as the party’s scribe, failing which he will be sent to prison for contempt.
The order contained in a judgement delivered by Justice C.O. Ajah, who advised Anyanwu to abide by his removal from office as PDP national secretary, otherwise, he will be guilty of contempt of court and be liable to be committed to prison.
The judgement is sequel to the case filed by Emmanuel Aniagu with the PDP, the party’s acting National Chairman, Iliya Damagun, Anyanwu and the PDP National Vice Chairman (South-East), Ali Odefa, as defendants.
Justice Ajah ruled that Anyanwu erred by agreeing to become the Imo State PDP gubernatorial candidate in April, 2023, whilst still doubling as the PDP national secretary, adding that “by occupying the two positions, the third defendant made —himself a judge in his own cause.

“The third defendant is hereby restrained forthwith, from further parading himself as the national secretary of the first defendant having relinquished the said position by conduct.”
The judge therefore ordered the PDP to recognize and swear- in, Udeh Okoye, who was recommended by the South East zonal executive committee of the party as the national secretary to serve out the remaining time of Anyanwu’s tenure.
Justice Ajah held that Anyanwu ran foul of the provisions of Sections 31 (20) (j) and (50) (1) of the PDP constitution and the electoral guidelines set by the party for the conduct of party primaries to choose PDP candidates to participate in the general elections in 2023.
