A Federal High Court sitting in Asaba, Delta State, has scheduled April 10, 2025, to rule on the bail application for the Chairman of the Delta State Universal Basic Education Board (SUBEB), Hon. Samuel Mariere, alongside the Ovie of Evwreni Kingdom, HRH Oghenekevwe Kumane, and others.

The high-profile case, which has gripped public attention, involves a six-count charge against the defendants, including allegations of terrorism, illegal possession of firearms, the murder of Prince Muvi Unagha, and the destruction of property in Evwreni Kingdom. The accused, including Keheide Kumane, Chief John Iyu, Ochuko Kumane, Ezekiel Odeimo, and five others, were arraigned before Justice F. A. Olubanjo on Monday, March 17, 2025.

During the court proceedings, Senior Advocate of Nigeria (SAN), Chief Albert Akpomudje, representing the defense, argued against the trial, stating that five other defendants were missing, making it legally improper to proceed without all accused persons present. He insisted that in cases of this nature, every defendant must be in court before the trial can officially begin.

Countering the argument, Mr. Sani Bagudu, counsel representing the Attorney General of the Federation, opposed the motion, asserting that the missing individuals had already been formally removed from the case and declared wanted. He emphasized that their absence did not hinder the trial of those in custody. Bagudu also objected to the bail application, warning that the defendants could pose a threat to witnesses if released, given the severity of the charges against them.

Following extensive deliberations, Justice Olubanjo ruled that the trial would proceed against the traditional ruler and the five defendants present in court. The judge subsequently adjourned the matter to April 10, 2025, for a ruling on their bail application. Additionally, the court fixed June 4, 5, and 6, 2025, for an accelerated hearing of the case.

The case has sparked widespread interest due to its implications for the political and traditional leadership structure in Delta State. As the trial progresses, all eyes remain on the judiciary to determine the fate of the embattled SUBEB chairman, the Evwreni monarch, and their co-defendants.
