Court adjourns Fubara impeachment suit indefinitely

A Rivers State High Court sitting in Port Harcourt has adjourned indefinitely the suit filed by Governor Siminalayi Fubara and his deputy, Professor Ngozi Nma-Odu, challenging the impeachment process initiated against them by the Rivers State House of Assembly.

The presiding judge, Justice Florence Fiberesima of the Oyigbo High Court, took the decision on Friday, January 23, 2026, following applications by counsel to the defendants seeking a stay of proceedings pending the determination of appeals already filed before the appellate court.

The suit arose from an impeachment notice issued against Governor Fubara and his deputy by the Speaker and 26 members of the Rivers State House of Assembly. Following the notice, the lawmakers directed the Chief Judge of the state to constitute a seven-member panel to investigate allegations of gross misconduct levelled against the governor and his deputy.

However, Governor Fubara had earlier secured an interim injunction restraining the Chief Judge from acting on the Assembly’s directive. Justice Fiberesima granted the order and initially adjourned further proceedings to January 23.

Meanwhile, the Chief Judge of Rivers State, Justice Simeon Amadi, subsequently wrote to the Speaker of the House, declining to set up the investigative panel in compliance with the court order. He also cited the fact that the Assembly had already filed an appeal challenging the High Court’s ruling.

With appeals now pending before the appellate court, Justice Fiberesima ruled that the matter should be adjourned indefinitely until the higher court determines the issues raised.
