Renowned constitutional lawyer and Senior Advocate of Nigeria (SAN), Mike Ahamba, has weighed in on the ongoing leadership tussle within the Peoples Democratic Party (PDP), asserting that Senator Samuel Anyanwu remains the party’s National Secretary until the Supreme Court delivers a final judgment on the matter.
The battle for the position has intensified between Anyanwu and Mr. Sunday Ude-Okoye, with both party officials citing separate court rulings to support their claims. However, Ahamba insists that the PDP Constitution is clear on the issue, stating that Anyanwu has not vacated his role since he never assumed office as Governor of Imo State.
Speaking exclusively to The Trumpet, Ahamba referenced Section 48(1) of the PDP Constitution, which stipulates that any party member holding an office at any level is deemed to have resigned if they assume positions such as Governor or Deputy Governor. He emphasized that contesting an election does not equate to assuming office, and therefore, Anyanwu’s position remains intact until the highest court in the land rules otherwise.
A veteran in both legal and political circles, Ahamba distanced himself from partisan interests, stressing that his position is based solely on constitutional interpretation. He urged party members to exercise patience and allow the Supreme Court to resolve the dispute, cautioning against the continuous legal battles that threaten the stability of the PDP.
As the internal wrangling continues, political observers await the Supreme Court’s verdict, which will ultimately determine the rightful occupant of the National Secretary position.
