The Supreme Court of Nigeria has declared Dr Ifeanyi Chukwuma Odii as the authentic governorship candidate of the Peoples Democratic Party ( PDP) in Ebonyi state.
In the lead judgment delivered by Justice Lawal Garba, the five-man panel headed by Amina Augie, noted that Senator Obinna Ogba did not have the right of appeal because he was not part of the suit when the matter came up at the trial court in Abakaliki, which upturned ogba’s candidature, and this necessitated Ogba approaching the Court of Appeal.
The apex court then struck out the judgment of the Court of Appeal, Abuja, which had earlier declared Obinna Ogba as the governorship candidate.

A five-member panel, presided by Justice Amina Augie, had on Wednesday said that the judgment would be delivered by 3 pm after entertaining final submissions from lawyers to parties in the appeal marked: SC/CV/ 939/2022, filed by Ifeanyi Chukwuma Odii.
Dr Odii and Senator Joseph Obinna Ogba had locked horns in a legal battle over who was validly elected as the party’s candidate in the 2023 governorship election in the state over primaries emanating from 28th, 29th May and 4th and 5th June 2022.
But not satisfied with the Appeal Court ruling, Ifeanyi Chukwuma Odii filed an appeal at the supreme court.
